1. Overview
These Terms & Conditions (“Agreement”) govern all bookings and services provided by Backyard Pines Golf Co.(“Company”, “we”, “us”, or “our”). By booking our services, you (“Client”, “you”) agree to the following terms.
2. Booking & Payment
- A deposit is required to secure your booking date.
- Full payment must be completed prior to or on the day of the event, unless otherwise agreed in writing.
- Payments can be made via approved methods (e-transfer, credit card, etc.).
- Bookings are not confirmed until a deposit has been received.
3. Cancellations & Refunds
- Deposits are non-refundable.
- Cancellations made within [X days] of the event may be subject to additional charges.
- In the event of extreme weather or unforeseen circumstances, we will work with you to reschedule where possible.
4. Setup Requirements
The Client is responsible for ensuring:
- Adequate space is available for safe setup and operation
- A suitable power source is accessible
- The setup area is clear, level, and free of hazards
- Weather conditions are suitable for operation (if outdoors)
- We reserve the right to refuse setup if conditions are deemed unsafe.
5. Equipment Use & Responsibility
- All equipment remains the property of Backyard Pines Golf Co.
- The Client assumes responsibility for all equipment during the rental period.
- Any damage caused by misuse, negligence, or failure to follow instructions may result in repair or replacement charges.
6. Participant Conduct
- Guests must use the simulator in a safe and respectful manner.
- Individuals who appear heavily intoxicated or impaired may be restricted from use.
- The Company reserves the right to stop service if safety concerns arise.
7. Liability Waiver
By using our services, the Client agrees:
- Backyard Pines Golf Co. is not liable for any injuries, damages, or losses resulting from use of the simulator.
- Participation is at the user’s own risk.
- The Client is responsible for ensuring all participants act safely.
8. Damage Deposit (if applicable)
- A refundable damage deposit may be required prior to the event.
- The deposit will be returned following inspection of equipment, provided no damage has occurred.
9. Weather Policy
- Outdoor setups are subject to weather conditions.
- High winds, heavy rain, or unsafe conditions may require cancellation or rescheduling.
- Final decisions regarding safety and operation are at our discretion.
10. Access & Timing
- The Client agrees to provide timely access to the event space for setup and teardown.
- Delays caused by restricted access may impact rental time.
11. Media & Promotion
- We may capture photos or videos of the setup for promotional use unless otherwise requested in writing prior to the event.
12. Governing Law
- This Agreement shall be governed by the laws of the Province of Ontario and applicable Canadian laws.
